1. Acceptance of These Terms

These Terms of Service (the "Terms") govern your access to and use of the Market Magicians website at marketmagicians.com, our free and Apprentice Discord communities, our live trading sessions, our social media channels (including Instagram @marketmagicians_), and any related content, products, or services we provide (collectively, the "Services").

By accessing the website, joining any Market Magicians community, or purchasing an Apprentice membership, you agree to be bound by these Terms and by our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. The Services are intended for individuals who are legally permitted to engage with financial and educational trading content in their jurisdiction.

3. The Services We Provide

Market Magicians operates an options trading education community. We offer a free Discord community open to anyone who joins, and a paid "Apprentice" membership that may include real-time trade alerts, daily live trading sessions, market analysis, watchlists, and direct access to our analyst team.

All content we publish — whether on the website, in Discord, in live sessions, or on social media — is provided for educational and informational purposes only. We may add, modify, suspend, or discontinue any part of the Services at any time without notice.

4. Not Financial Advice

Nothing provided through the Services constitutes financial, investment, trading, tax, or legal advice, nor a recommendation or solicitation to buy, sell, or hold any security, option, cryptocurrency, or other financial instrument. Market Magicians and its team are not registered investment advisors, broker-dealers, or licensed financial professionals.

No fiduciary relationship is created between you and Market Magicians. You are solely responsible for your own trading and investment decisions and for evaluating the merits and risks of any idea discussed. 5. No Guarantee of Results

Trading and investing in stocks, options, and other financial instruments involves substantial risk of loss and is not suitable for every person. Past performance of any trade, strategy, or idea is not indicative of future results. We do not guarantee any profit, income, or specific outcome from your use of the Services. Any examples of returns or performance are illustrative only and are not promises of future performance.

6. Memberships, Billing & Payments

Apprentice memberships are sold and processed through our third-party platform, Whop. By purchasing a membership, you also agree to Whop's terms and to the payment terms presented at checkout. We do not collect or store your full payment card details; payment processing is handled by Whop and its payment partners.

Unless stated otherwise at checkout, memberships are recurring subscriptions that automatically renew at the end of each billing period at the then-current price until cancelled. You authorize recurring charges to your selected payment method until you cancel. We may change membership pricing or features on a prospective basis; any price change will apply to your next billing cycle.

7. Cancellations & Refunds

You may cancel your Apprentice membership at any time through your Whop account. Cancellation stops future renewals; you will generally retain access until the end of your current paid billing period. Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused access. Any refund requests are subject to our discretion and to Whop's policies.

8. Acceptable Use & Community Conduct

When using the Services — particularly our Discord communities — you agree to follow our community rules and to behave respectfully. You agree not to:

• ·Harass, threaten, demean, or discriminate against other members or staff.
• ·Post spam, advertisements, referral links, or self-promotion without prior staff approval.
• ·Share, resell, redistribute, or publicly post Apprentice content, alerts, or live sessions to anyone outside your own membership.
• ·Share login credentials or allow others to access Apprentice content through your account.
• ·Impersonate Market Magicians, its team, or any other person, or post unlawful, infringing, or misleading content.
• ·Attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the Services or their systems.

9. Intellectual Property

All content, trademarks, logos, branding, analysis, written material, graphics, and other materials made available through the Services are owned by or licensed to Market Magicians and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use our content for your own personal, non-commercial, educational use. You may not copy, reproduce, distribute, sell, or create derivative works from our content without our prior written permission.

10. Member Content

Our communities allow members to post messages, ideas, and other content. You retain ownership of content you submit, but you grant Market Magicians a worldwide, royalty-free license to host, display, and use that content as needed to operate the Services. You are solely responsible for content you post and represent that you have the rights to share it. We do not endorse, verify, or take responsibility for member-generated content and may remove any content at our discretion.

11. Third-Party Services & Links

The Services rely on and link to third-party platforms, including Discord, Whop, and social media providers, and may contain affiliate or referral links. We are not responsible for the content, policies, availability, or practices of any third-party service. Your use of those services is governed by their own terms and privacy policies. Where we receive compensation through affiliate or referral links, we disclose such relationships where required by law.

12. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content, data, or alert will be accurate, complete, or timely.

13. Limitation of Liability

To the maximum extent permitted by law, Market Magicians and its team, owners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses, lost profits, or lost data, arising out of or relating to your use of the Services — even if advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability to you will not exceed the amount you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Market Magicians and its team, owners, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any law, or your infringement of any third-party right.

15. Suspension & Termination

We may suspend, restrict, or terminate your access to all or part of the Services — including removal from our Discord communities and cancellation of an Apprentice membership — at any time and without notice if we believe you have violated these Terms or our community rules, or to protect the Services or other members. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may also be communicated through the website or our communities. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Minnesota and the United States, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to the Services or these Terms will be resolved on an individual basis, and you and Market Magicians submit to the exclusive jurisdiction of the state and federal courts located in Minnesota, except where applicable law provides otherwise.

18. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Market Magicians regarding the Services and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision.
